Welcome to ArcaVida. By accessing or using our website (https://arcavida.cr), inquiring about our container homes, booking an Airbnb stay, or engaging with our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you and ArcaVida, a business registered in Costa Rica.
ArcaVida provides the following services:
• Custom Container Homes: Design, construction, and delivery of sustainable container homes
• Airbnb Stays: Short-term rental accommodations in container homes
• Retreat Hosting: Eco-friendly retreat experiences in Costa Rica
• Consultation Services: Project planning, design consultations, and financing guidance
You must be at least 18 years of age to use our services. By using our website, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract.
4.1 Quotations and Proposals
All quotations and proposals provided by ArcaVida are estimates and subject to change based on final design specifications, material costs, and site conditions.
4.2 Contracts and Deposits
A formal contract will be executed before commencing any container home project. A deposit (typically 30-50% of the total project cost) is required to begin work. Deposit amounts and payment schedules will be outlined in the contract.
4.3 Land Requirements
Clients must own or have legal access to the land where the container home will be delivered and installed. ArcaVida is not responsible for land acquisition, zoning approvals, or permits unless explicitly included in the contract.
4.4 Delivery and Installation
Delivery timelines are estimates (typically 60-90 days) and may vary due to customization, material availability, weather, or unforeseen circumstances. ArcaVida will make reasonable efforts to meet agreed-upon timelines but is not liable for delays beyond our control.
4.5 Permits and Compliance
While ArcaVida designs container homes to comply with Costa Rican building codes, clients are responsible for obtaining necessary permits and approvals from local authorities unless otherwise agreed in writing.
4.6 Warranty
ArcaVida provides a 1-year limited warranty on structural defects and workmanship. This warranty does not cover normal wear and tear, damage caused by misuse, natural disasters, or modifications made by third parties.
5.1 Booking Terms
Airbnb stays are subject to availability and must be booked through our official Airbnb listing or directly through ArcaVida. All bookings are confirmed upon receipt of payment.
5.2 Cancellation Policy
Cancellations are subject to the cancellation policy stated at the time of booking (typically moderate or strict cancellation policy as per Airbnb standards). Refunds, if applicable, will be processed according to the stated policy.
5.3 Guest Responsibilities
Guests are responsible for:
• Treating the property with care and respect
• Complying with house rules provided at check-in
• Reporting any damages or issues immediately
• Paying for any damages caused during their stay
5.4 Liability
ArcaVida is not liable for personal injury, loss of personal property, or any damages incurred during your stay, except where caused by our gross negligence or willful misconduct.
6.1 Accepted Payment Methods
We accept payments via bank transfer, credit/debit cards, and other methods as agreed upon in writing.
6.2 Currency
All prices are quoted in USD (United States Dollars) unless otherwise specified.
6.3 Late Payments
Late payments may incur interest charges of 1.5% per month or the maximum rate permitted under Costa Rican law, whichever is lower.
6.4 Taxes
All prices are exclusive of applicable taxes (e.g., Costa Rican sales tax/IVA). Clients are responsible for all taxes, duties, and fees associated with their purchase.
7.1 Ownership
All designs, plans, drawings, images, logos, and content on the ArcaVida website are the intellectual property of ArcaVida and are protected by Costa Rican and international copyright laws.
7.2 Limited License
Clients who purchase a container home receive a limited, non-transferable license to use the design for their personal project. Clients may not reproduce, sell, or distribute ArcaVida designs without written permission.
7.3 Website Content
You may not copy, reproduce, distribute, or create derivative works from any content on our website without our express written consent.
You agree not to:
• Use our website for any unlawful purpose
• Submit false or misleading information
• Interfere with the operation of our website or services
• Attempt to gain unauthorized access to our systems
• Harass, threaten, or defame ArcaVida or its employees
We reserve the right to terminate your access to our services if you violate these Terms.
9.1 Website Availability
We strive to keep our website available 24/7, but we do not guarantee uninterrupted access. We are not liable for any downtime, technical issues, or data loss.
9.2 Information Accuracy
While we make reasonable efforts to ensure the accuracy of information on our website, we do not warrant that all content is complete, current, or error-free.
9.3 Third-Party Links
Our website may contain links to third-party websites (e.g., Airbnb, social media). We are not responsible for the content, policies, or practices of these external sites.
9.4 Limitation of Liability
To the maximum extent permitted by Costa Rican law, ArcaVida shall not be liable for:
• Indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, or business opportunities
• Damages exceeding the amount paid by the client for the specific service
You agree to indemnify and hold harmless ArcaVida, its employees, contractors, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
ArcaVida is not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to:
• Natural disasters (earthquakes, hurricanes, floods)
• Government actions, war, or civil unrest
• Pandemics or public health emergencies
• Strikes, labor disputes, or supply chain disruptions
12.1 Governing Law
These Terms are governed by the laws of Costa Rica. Any disputes shall be resolved in accordance with Costa Rican law.
12.2 Jurisdiction
Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of San José, Costa Rica.
12.3 Mediation and Arbitration
Before initiating legal proceedings, both parties agree to attempt resolution through good-faith mediation. If mediation fails, disputes may be resolved through binding arbitration in accordance with Costa Rican arbitration rules.
ArcaVida reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
We encourage you to review these Terms periodically.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy and any written contracts, constitute the entire agreement between you and ArcaVida regarding the use of our services.
